Terms & Conditions

Welcome to Loto Moana. These Terms & Conditions govern your access to and use of our website and the purchase of apparel from Pacific Business Development Ltd, trading as Loto Moana (“we”, “us”, “our”). By placing an order, you agree to these Terms.

1. Your Rights Under New Zealand Law

Nothing in these Terms limits or excludes your rights under the Consumer Guarantees Act 1993 (CGA), the Fair Trading Act 1986 (FTA), the Privacy Act 2020, or any other applicable New Zealand law.

2. Product Integrity & Representation

We present our garments with care, accuracy and integrity. All descriptions, sizing guides, fabric compositions and imagery are provided in compliance with the Fair Trading Act 1986. Minor variations in colour or fit may occur due to screen displays or manufacturing tolerances.

3. Pricing & Payment

All prices are listed in NZD and include GST unless otherwise stated. Shipping costs are calculated at checkout. We reserve the right to correct pricing errors prior to dispatch.

4. Afterpay / Laybuy

We may offer third-party payment providers such as Afterpay or Laybuy. These services operate under their own terms and conditions. We are not responsible for approvals, fees, or payment arrangements governed by those providers.

5. Orders & Dispatch

A binding contract is formed once dispatch confirmation has been issued. We reserve the right to cancel orders due to stock unavailability, pricing error, suspected fraud, or breach of these Terms. A full refund will be provided if we cancel your order.

6. Consumer Guarantees (Apparel)

Our garments must be of acceptable quality, durable, fit for purpose, and match their description under the Consumer Guarantees Act 1993. Where a product fails to meet these guarantees, you are entitled to a repair, replacement, or refund as required by law.

7. International Orders

For orders shipped outside New Zealand, local consumer protection laws may apply. Any customs duties, taxes, or import fees are the responsibility of the purchaser unless stated otherwise.

8. Intellectual Property

All branding, designs, logos, images and website content remain the property of Pacific Business Development Ltd and may not be reproduced without prior written consent.

9. Limitation of Liability

Nothing in these Terms limits liability where it would be unlawful to do so. Where permitted by law, liability is limited to the purchase price of the goods supplied.
